Volusia County Defendant Convicted of Manslaughter

DAYTONA BEACH – After a two-day trial this afternoon, a Volusia County jury found defendant Allen Gainous guilty as charged of Manslaughter. Immediately following the verdict, the defendant was sentenced to 11 years in prison followed by four years of probation.

On the evening of February 11, 2022, Gainous was verballing arguing with another man outside of a convenience store on Nova Road in Daytona Beach. Video surveillance then shows the defendant punch the victim in the face three times, which caused him to fall backward and hit his head on a concrete sidewalk.

Gainous drove away from the scene. The victim died from his injuries at the hospital several days later.

“This case is a grim reminder that fists can be deadly weapons,” State Attorney R.J. Larizza said about the case.

The case was investigated by the Daytona Beach Police Department. Assistant State Attorneys Ashley McCarthy and Boone Forkner successfully tried the case for the state. The Honorable Michael Orfinger presided over the case and pronounced sentence.
